From Liquidation to Litigation:Â
How Legal Proceedings Led to Full Payment for AGA Scaffolding
Â
AGA Scaffolding is a London based company with over 10 years of experience in the scaffolding industry. They provide services across industrial, commercial and residential sectors, covering all areas of London and specialising in both scaffold hire and installation.
The challenge
When a client failed to pay for scaffolding services, AGA Scaffolding faced a challenge when attempted to resolve the issue themselves by reaching out to the debtor were unsuccessful. After four months of failed contact, they enlisted our Collections service to help recover the funds on their behalf.Â
Our approach
This case required a strategic recovery plan, focused on clear and direct communication to ensure AGA Scaffolding’s client could no longer ignore the outstanding debt.Â
Early in-depth background checks established early the debtor was pre insolvency, allowing us to prepare for the possibility of the debtor entering into liquidation. When the debtor did enter into liquidation, we filed our client’s interest, ensuring they would receive a dividend if payable.
A few months later, we discovered the debtor was still trading. With AGA Scaffolding’s authorisation, we initiated the appropriate legal proceedings ultimately securing full payment of the claimed balance.
Outcome
Despite the debtor initially entering liquidation, our proactive approach ensured that our client’s interest was formally lodged, securing their entitlement to any potential dividend. Upon discovering that the debtor was still trading, we promptly pursued the necessary legal action. This decisive step resulted in the full repayment of the debt, allowing AGA Scaffolding to recover the funds owed to them and continue their operations without financial loss.
